Tidigt användande av cannabis

1545 Spanjorerna introducerar cannabis i Chile[1]

1611 Bosättarna i Jamestown har med sig cannabis som odlas för sina fibers skull.

1629 Cannabis introduceras i New England.

1765-1767 George Washington odlar cannabis.[1][2] Möjligen endast för fiber, men det finns indikationer på att det även kan ha funnits andra anledningar, han skriver i sin dagbok att han bl.a sorterade bort hanplantorna för sent. Det finns ingen anledning att sortera hanplantor i fibertillverkningen, däremot är det bra för att få opollinerade honor som inte har frön och har högre THC-halt, men man ska göra det tidigt.[3][4].

1762 Virginia utfärdar belöningar för hampaodling/fibertillverkning och utfärdar böter till de som inte odlar.[1]

Tidigt 1800-tal, President Thomas Jefferson odlar hampa. [5]

1843 Cannabis omnämns som läkemedel i USA. [6]

1850 Man räknade till 8,327 planteringar av hampa (minimum 2,000-hektars farm). [7]

1851 Bland användningsområden för medicinsk cannabis nämns "neuralgia, gout, rheumatism, tetanus, hydrophobia, epidemic cholera, convulsions, chorea, hemorrhage"[1]

1860 Morfin används för första gången i stor skala under inbördeskriget. Det uppskattas att 400,000 var beroende efter kriget. Beroendet blev allmänt känts under namnet "soldatsjukan" för att det var så vanligt.[8][9].

Det var under senare delen av 1800-talet även vanligt att städer/orternas apotekare blandade ihop en egen blandning med opium och andra örter som såldes som piller, oljor, eller upplöst i sprit och marknadsfördes med häftiga namn som universalbotemedel mot allt från smärta, sömnproblem, stress .m.m.

1875 San Francisco förbjuder rökande av opium i s.k opiumhålor. Ett förbud som främst riktar in sig på den kinesiska befolkningen. [3]

1887 Kongressen förbjuder kineser att importera opium.[3]

1889 Missouri förbjuder opiumhålor och hash-bjudningar. [10]

1890 Endast amerikaner får tillverka opium[3]

Tidigt 1900-tal

1909 förbjuds rökningen av opium. Anledningen är att det anses vara kinesiskt. Att äta eller injicera är helt fortfarande helt ok. [3]

1911 Massachusetts inför restriktioner på cannabis i en läkemedelslag[10]

1912 "International Opium Convention", många länder skriver på ett internationellt avtal att förbjuda opium.[12]

1913 Kalifornien förbjuder innehav av cannabis, men det verkar inte drivits så hårt då cannabis fortsatte förskrivas. [10]

1914 New York lagstiftar att cannabis blir receptbelagd.[10]

1914 Lagen "The Harrison Act" gör opium och kokain olagligt.

Förbudet mot alkohol 1920-1933

Nykterhetsrörelsen hade verkat i USA sedan 1820-talet och man hade i vissa delstater i omgångar förbjudit sprit eller genomdrivit andra åtgärder mot barer och alkoholismen. Under 1910-talet fanns det en majoritet bland både demokrater och republikaner som ville genomföra ett totalförbud mot spriten. Men först under 1:a världskriget kunde man klubba igenom ett förbud, med förevändningen att massor av råg som användes till spritproduktionen istället kunde användas till krigsinsatserna i Europa.

Volstead Act[13] tillsammans med 18:th Amendment [14] bildade lagstiftningen mot alkohol.

Under förbudet som rådde från 1920-1933 så försvann inte efterfrågan och det föddes en enorm inkomstkälla för de som kunde ordna tillgången. Olika maffiaorganisationer växte fram som importerade sprit från Kanada och Europa. Kampen om marknaden ledde till många blodiga konflikter. Här kunde gangsters som Al Capone och Bugs Moran tjäna miljontals dollar.[15]

Under tiden pågick en kampanj mot cannabis. Mediamogulen William Randolf Hearst som ägde många av de stora tidningarna var en stark anhängare av förbudspolitiken. Dels för att hotet från den hemska marijuanan sålde bra, men även av rasistiska skäl, samt möjligen att cannabis röktes av många mexikaner och Hearsts familj hade blivit av med land och egendom i Mexiko under revolutionen på 1910-1920.[16]

När förbudet mot alkohol upphävdes 1933 hade 30 stater stiftat någon form av lag mot cannabis, men nu skulle alla med.[10]

The campaign against cannabis heated up after Repeal. "I wish I could show you what a small marihuana cigaret can do to one of our degenerate Spanish-speaking residents," a Colorado newspaper editor wrote in 1936. "The fatal marihuana cigarette must be recognized as a DEADLY DRUG, and American children must be PROTECTED AGAINST IT," the Hearst newspapers editorialized.

Hasheesh makes a murderer who kills for the love of killing out of the mildest mannered man who ever laughed at the idea that any habit could ever get him.

Rasism och fördomar i propagandan mot cannabis

Exempel på fördomar som förekommer i tidningarna i början av 1900-talet.

In 1901, Congress forbade the sale of opium and alcohol "to aboriginal tribes and uncivilized races", and later extended this to include "uncivilized elements in America itself and in its territories, such as Indians, Alaskans, the inhabitants of Hawaii, railroad workers, and immigrants at ports of entry."[17]

Marijuana prohibition started in the Southwest, where "the dirty greasers grow", as sung by soldiers under General Pershing.[18] A Texas police captain summed up the problem: under marijuana, Mexicans became "very violent, especially when they become angry and will attack an officer even if a gun is drawn on him. They seem to have no fear, I have also noted that under the influence of this weed they have enormous strength and that it will take several men to handle one man while under ordinary circumstances one man could handle him with ease."[19]

According to the Butte Montana Standard, in 1927, "When some beet field peon takes a few traces of this stuff... he thinks he has just been elected president of Mexico, so he starts out to execute all his political enemies."[19]

The American Coalition, an anti-foreigner group, stated "Marihuana, perhaps now the most insidious of our narcotics, is a direct by-product of unrestricted Mexican immigration. Easily grown, it has been asserted that it has recently been planted between rows in a California penitentiary garden. Mexican peddlers have been caught distributing sample marihuana cigarets to school children. Bills for our quota against Mexico have been blocked mysteriously in every Congress since the 1924 Quota Act. Our nation has more than enough laborers."[19]

According to the Missionary Educator Movement, "The use of marihuana is not uncommon in the colonies of the lower class of Mexican immigrants. This is a native drug made from what is sometimes called the 'crazy weed.' The effects are high exhilaration and intoxication, followed by extreme depression and broken nerves. Police officers and Mexicans both ascribe many of the moral irregularities of Mexicans to the effects of marihuana."[20]

The very name marihuana was introduced at this time to make it sound Mexican--some interests didn't even realize that marihuana and hemp were the same plant. Lobbyists for the birdseed industry, for example, arrived with barely enough time to get an exemption, because they hadn't realized that marihuana was what they were putting in their seed[19], and Eric Partridge's Dictionary of Slang says "hemp" is a slang word for marijuana, since "it resembles that plant".

There was a strong reliance on the use of racist language and imagery to galvanize popular and political support for strict anti-drug measures and this was to become a core feature of anti-drug measures in the U.S. In his role as the first U.S. drug ‘tsar’ Hamilton Wright worked with William Randolph Hearst’s newspaper empire to generate concern around substance use among minority groups. In an interview with the New York Times in March 1911, Wright focused public and media attention on the dangers posed to white American society by cocaine use among African Americans. This was further developed in the Literary Digestand Good Housekeeping, were Wright elaborated on the danger posed to white women by ‘negro cocaine peddlers’ and ‘cocainized nigger rapists’. These ‘Negro fiends’ with cocaine induced superhuman strengths easily substituted for the opium wielding Chinese ‘devils’ of the earlier anti-opium propaganda.

Among the reams of shockingly racist articles from the period was a New York Timespiece by Edward Huntington Williams. This claimed that cocaine made African-Americans resistant to bullets. (New York Times, February 8 1914). In the Congressional hearings into the 1914 Harrison bill, the head of the State Pharmacy Board of Pennsylvania, Christopher Koch testified that: ‘Most of the attacks upon the white women of the south are the direct result of the cocaine-crazed Negro brain’ (New York Times, Feb. 8, 1914). In the build up to the 1937 Marijuana Tax Act, Mexican migrants emerged as the new drug threat. It was claimed that ‘marijuana crazed Mexicans’ were committing violent acts after smoking the ‘loco weed’. By emphasizing the threat faced by American society, the F.B.N. was positioned to substantially increase its share of federal revenues.

From 1910 to 1920, Hearst's newspapers would claim that the majority of incidents in which blacks were said to have raped white women, could be traced directly to cocaine. This continued for 10 years until Hearst decided it was not "cocaine-crazed Negroes" raping white women - it was now "marijuana-crazed Negroes" raping white women.

Hearst's and other sensationalistic tabloids ran hysterical headlines atop stories portraying "Negroes" and Mexicans as frenzied beasts who, under the influence of marijuana, would play anti-white "voodoo-satanic" music (jazz) and heap disrespect and "viciousness" upon the predominantly white readership. Other such offenses resulting from this drug-induced "crime wave" included: stepping on white men's shadows, looking white people directly in the eye for three seconds or more, looking at a white woman twice, laughing at a white person, etc.

For such "crimes", hundreds of thousands of Mexicans and blacks spent, in aggregate, millions of years in jails, prisons and on chain gangs, under brutal segregation laws that remained in effect throughout the U.S. until the 1950s and '60s. Hearst, through pervasive and repetitive use, pounded the obscure Mexican slang word "marijuana" into the English-speaking American consciousness. Meanwhile, the word "hemp" was discarded and "cannabis," the scientific term, was ignored and buried.

The actual Spanish word for hemp is "canamo." But using a Mexican "Sonoran" colloquialism - marijuana, often Americanized as "marihuana" - guaranteed that few would realize that the proper terms for one of the chief natural medicines, "cannabis," and for the premiere industrial resource, "hemp," had been pushed out of the language.

1930-talet

1930 blev Harry J. Anslinger chef för "The Federal Bureau of Narcotics". Anslinger var en framgångsrik byråkrat och hade genom sin fru släktband med finansministern Andrew W. Mellon. Under 1920-talet hade han jobbat mot smugglingen av alkohol och var en stark motståndare till allt vad droger hette och såg som sitt kall att radera alla skadliga droger från jordens yta. Problemet var att det inte fanns så många missbrukare av kokain och heroin på denna tiden. Hans byrå var mycket liten och obetydlig. En artikel i tidningen 1927 om en familj som blivit "galna" efter att ha ätit en cannabisplanta gav honom dock en snilleblixt om hur han skulle kunna utöka verksamheten. Cannabis skulle bli det nya hotet som måste stoppas till varje pris. Han lyssnade inte på motståndet från läkarvärlden som inte såg några problem med cannabis. Propagandamaskineriet började nu pränta in i varje amerikan att om du eller en familjemedlem röker cannabis så kommer vederbörande oundvikligen att hugga ihjäl familjen och hacka dom i småbitar[22].

1936 kommer propagandafilmen "Reefer Madness" som visar hur galna alla blir som röker cannabis.

Anslinger skriver även en lång artikel kallad "Marijuana, Assassin of Youth".

Not long ago the body of a young girl lay crushed on the sidewalk after a plunge from a Chicago apartment window. Everyone called it suicide, but actually it was murder. the killer was a narcotic known to America as marijuana, and to history as hashish. Used in the form of cigarettes, it is comparatively new to the United States and as dangerous as a coiled rattlesnake. How many murders, suicides, and maniacal deeds it causes each year, especially among the young, can only be conjectured.

The Marihuana Tax Act

1937 så driver man igenom "The Marihuana Tax Act" som lägger enorma straffskatter på odlingen av cannabis.

SENATOR DAVIS: How many cigarettes would you have to smoke before you got this vicious mental attitude toward your neighbor?

MR. ANSLINGER: I believe in some cases one cigarette might develop a homicidal mania, probably to kill his brother. It depends on the physical characteristics of the individual. Every individual reacts differently to the drug. It stimulates some and others it depresses. It is impossible to say just what the action of the drug will be on a given individual, of the amount. Probably some people could smoke five before it would take that effect, but all the experts agree that the continued use leads to insanity. There are many cases of insanity.

I utredningen så minimeras användningen av ordet hampa då det förknippas med alla cannabisens positiva användningsområden man använder istället marihuana, det spanska namnet som används för växtdrogen. En representant för AMA (American Medical Association) tycker att det finns för få bevis för problem som skulle motivera ett förbud. Men det sker ändå.

"I say the medicinal use of Cannabis has nothing to do with Cannabis or marihuana addiction. In all that you have heard here thus far, no mention has been made of any excessive use of the drug by any doctor or its excessive distribution by any pharmacist. And yet the burden of this bill is placed heavily on the doctors and pharmacists of the country; and I may say very heavily, most heavily, possibly of all, on the farmers of the country"

That use, by the way, was recognized by John Stuart Mill in his work on psychology, where he referred to the ability of Cannabis or Indian hemp to revive old memories, and psychoanalysis depends on revivification of hidden memories. That there is a certain amount of narcotic addiction of an objectionable character no one will deny. The newspapers have called attention to it so prominently that there must be some grounds for there statements. It has surprised me, however, that the facts on which these statements have been based have not been brought before this committee by competent primary evidence. We are referred to newspaper publications concerning the prevalence of marihuana addiction. We are told that the use of marihuana causes crime. But yet no one has been produced from the Bureau of Prisons to show the number of prisoners who have been found addicted to the marihuana habit. An informed inquiry shows that the Bureau of Prisons has no evidence on that point. You have been told that school children are great users of marihuana cigarettes. No one has been summoned from the Children's Bureau to show the nature and extent of the habit, among children. Inquiry of the Children's Bureau shows that they have had no occasion to investigate it and know nothing particularly of it. Inquiry of the Office of Education - and they certainly should know something of the prevalence of the habit among the school children of the country, if there is a prevalent habit - indicates that they have had no occasion to investigate and know nothing of it."

1940-talet

Under andra världskriget tvingas man att tillfälligt upphäva totalförbudet när man måste odla mycket stora mängder cannabis för att kunna göra textiler, rep, etc. till kriget.

In 1942, after the Japanese invasion of the Philippines cut off the supply of Manila (Abaca) hemp, the U.S. Government distributed 400,000 pounds of cannabis seeds to American farmers from Wisconsin to Kentucky, who produced 42,000 tons of hemp fiber annually until 1946 when the war ended.

Hemp For Victory:

Efter kriget så är det kommunismen som man förknippar med användningen av droger. Dom som röker får socialistiska värderingar och är ett hot mot det amerikanska, kapitalistiska samhället.

1948 "Marihuana leads to pacifism and Communist brainwashing." var ett argument som framfördes av Anslinger inför kongressen.

1960-talet

Single Convention on Narcotic Drugs

1961 Tidigare internationella lagar hade bara kontrollerat växterna opium och koka och drogerna morfin, heroin och kokain. USA hade nu som mål att även förbjuda cannabis i hela världen. Det skulle göra det mycket enklare för USA:s interna förbudspolitik om det inte fanns något utanför landet som kunde smugglas in. USA var därför drivande i I FN för framtagandet av en global lagstiftning mot droger. Den kom 1961 och kallades "Single Convention on Narcotic Drugs"[25] och började gälla 1964.[26] 2012 var 183 länder anslutna till konventionen[27]

Den reglerar allt från odling, tillverkning och smuggling till försäljning, hantering och innehav.

1970-talet

1970 "Controlled Substances Act" skapas. Den anpassar lagstiftningen till "Single Convention on Narcotic Drugs". Men det kommer inte dröja länge innan man tar nästa steg. [26]

"Convention on Psychotropic Substances

1971 Under 60-talet hade bruket av droger ökat och man ville lagstifta bort missbruket av många nya droger, exempelvis LSD som var lagligt i USA fram tills 1967. USA propagerade i FN för att fler droger skulle förbjudas internationellt. Det ledde till "Convention on Psychotropic Substances"[28] som undertecknades 1971 och började gälla 1976. Den reglerar amfetaminer, barbiturater, benzodiazepiner och psykedelia. [29]

Detta leder till lagen "Psychotropic Substances Act" 1978 som i USA förstärker och anpassar den tidigare lagstiftningen i enlighet med den nya FN-lagstiftningen.[30]

1971 Det rapporteras att tio till femton procent av soldaterna som deltar i kriget i Vietnam är beroende av heroin. Richard Nixon ville visa handlingskraftighet, en hårdhet mot buset och knarkproblemet. Eftersom krig alltid ansetts vara det effektivaste problemet mot olika problem så är det här som "War on drugs" myntas för första gången. [31][32]

Hemliga inspelningar av Nixon visar prov på antisemitism och ett rent hat mot cannabis:

RN: "Now, this is one thing I want. I want a Goddamn strong statement on marijuana. Can I get that out of this sonofabitching, uh, Domestic Council?"

HRH: "Sure."

RN: "I mean one on marijuana that just tears the ass out of them. I see another thing in the news summary this morning about it. You know it's a funny thing, every one of the bastards that are out for legalizing marijuana is Jewish. What the Christ is the matter with the Jews, Bob, what is the matter with them? I suppose it's because most of them are psychiatrists, you know, there's so many, all the greatest psychiatrists are Jewish. By God we are going to hit the marijuana thing, and I want to hit it right square in the puss, I want to find a way of putting more on that. More (unintelligible) work with somebody else with this."

HRH: "Mm hmm, yep."

RN: "I want to hit it, against legalizing and all that sort of thing."

President Nixons assistent John Ehrlichman har t.o.m erkänt för en journalist 1994 att kriget mot droger var ett krig mot hippies och svarta:

I started to ask Ehrlichman a series of earnest, wonky questions that he impatiently waved away. “You want to know what this was really all about?” he asked with the bluntness of a man who, after public disgrace and a stretch in federal prison, had little left to protect. “The Nixon campaign in 1968, and the Nixon White House after that, had two enemies: the antiwar left and black people. You understand what I’m saying? We knew we couldn’t make it illegal to be either against the war or black, but by getting the public to associate the hippies with marijuana and blacks with heroin, and then criminalizing both heavily, we could disrupt those communities. We could arrest their leaders, raid their homes, break up their meetings, and vilify them night after night on the evening news. Did we know we were lying about the drugs? Of course we did.”

1973 Drug Enforcement Administration (DEA) skapas.[32]

1974 Nils Bejerot var i USA för att uttala sig i rollen som utländsk expert från landet där repressionen var en framgång.

Nils Bejerot var en av de få svenska experter som kallats att vittna inför ett amerikanskt senatsutskott. Det skedde 1974, då senatens justitieutskott höll en serie förhör om farligheten av cannabis (haschisch, marijuana). Förhören formade sig till en fyllig redovisning av nya vetenskapliga rön om skador av cannabis. Nils talade om "Fysiska, psykiska och sociala konsekvenser av användning av cannabis och frågan om legalisering av försäljning och användning av marijuana". Han påpekade att kraven på legalisering av cannabis hade varit starkast i de länder som haft den kortaste erfarenheten av de svagaste formerna av drogen och att man inte hade tagit till sig kunskaperna från de länder som haft månghundraårigt missbruk, t.ex. Egypten. Han varnade också för att en legalisering av cannabis i USA skulle bli början till en irreversibel process inte bara för det landet utan för hela vår civilisation: "Konsekvenserna skulle bli så omfattande att ingen för närvarande kan överblicka dem". Nils gav en översikt över sina narkotikapolitiska erfarenheter, bl.a. från den svenska legalförskrivningsperioden (1965-1967), då narkotikakontrollen i Stockholm i det närmaste var satt ur spel. Han påpekade att en permissiv narkotikapolitik bidrar till en ökning av missbruket och att en restriktiv narkotikapolitik driver tillbaka detta.

Iran/Contras-skandalen

Mellan 1981 och 1989 var Ronald Reagan president.

1986 skakades USA då en jätteskandal avslöjades. I slutet av 70-talet hade en grupp amerikaner tillfångatagits av Iran. För att frige dem ingick man under 80-talet ett avtal att sälja vapen till Iran (något som hade förbjudits av kongressen) för deras frihet. USA hade sedan använt en del av pengarna från försäljningen till att finansiera en revolutionär organisation (som använde terrordåd som medel) i Nicaragua som kallades Contras[36]. Contras skulle försöka störta den socialistiska regeringen i landet. Men i bakgrunden fanns även en annan skandal. CIA hade varit mellanhänder för droginköp där säljaren var Contras och köparna var amerikanska kriminella organisationer. Allt för att Contras skulle få pengar till sin kamp. Man hade t.o.m betalat för att dessa köp skulle göras.

Contra drug links included... payments to drug traffickers by the U.S. State Department of funds authorized by the Congress for humanitarian assistance to the Contras, in some cases after the traffickers had been indicted by federal law enforcement agencies on drug charges, in others while traffickers were under active investigation by these same agencies." The U.S. State Department paid over $806,000 to known drug traffickers to carry humanitarian assistance to the Contras.

Det har senare spekulerats att denna massiva handeln låg till grund för att crack (kokainfribas) skapade en närmast epidemisk missbruksvåg över USA under 80-talet.[38]

War On Drugs

1986 Samtidigt som CIA försåg USA med kokain så sade man sig från högsta post vilja utrota knarket med alla medel. Och vad är det effektivaste sättet USA känner till? Krig naturligtvis! Nixon hade använts uttrycket på 70-talet, men det var nu dags att ta upp det igen och ha en större krigsbudget.

Midway into his second term, Reagan declared more militant policies in the War on Drugs. He said that "drugs were menacing our society" and promised to fight for drug-free schools and workplaces, expanded drug treatment, stronger law enforcement and drug interdiction efforts, and greater public awareness.

In 1986, Reagan signed a drug enforcement bill that budgeted $1.7 billion to fund the War on Drugs and specified a mandatory minimum penalty for drug offenses. The bill was criticized for promoting significant racial disparities in the prison population and critics also charged that the policies did little to reduce the availability of drugs on the street, while resulting in a great financial burden for America. Defenders of the effort point to success in reducing rates of adolescent drug use. First Lady Nancy Reagan made the War on Drugs her main priority by founding the "Just Say No" drug awareness campaign, which aimed to discourage children and teenagers from engaging in recreational drug use by offering various ways of saying "no". Mrs. Reagan traveled to 65 cities in 33 states, raising awareness about the dangers of drugs including alcohol.

United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances

1988 kom "United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances"[39] från FN. Lagstiftningen trädde i kraft 1990. Den är ett tillägg till 1961 års "Single Convention on Narcotic Drugs och 1971 års "Convention on Psychotropic Substances". Den lägger mer kraft på att komma åt organiserad brottslighet genom bl.a konfiskering av tillgångar. Man inför även förbud för vissa prekursorer. En annan nyhet är en uppmaning till länderna att införa förbud mot att inneha narkotika för personligt bruk. [40]. Just det sistnämnda efterföljs inte av alla länder men USA och Sverige tyckte naturligtvis att det skulle vara en effektiv metod.

1990-talet

Bush den äldre fortsätter kriget mot droger.

Med Bill Clinton som president händer det inte heller inget avvikande. Business as usual. Clinton hade visserligen erkänt att han hade kommit i kontakt med en joint när han var ung, men han hävdade att han inte hade inhalerat röken utan bara tagit ett munbloss. Att han skulle ha inhalerat den hemska drogen hade varit mycket illa, han hade förmodligen blivit mördare istället för president. Men hade han ändå blivit president hade det varit förödande rent opinionsmässigt att ha en f.d knarkare som president i landet som bedriver ett krig mot knark, inte bra alls.

2000-talet

George W Bush-administrationen tillför inget särskilt. Bush lyckas med att koppla ihop terrorism med narkotika genom att hävda att terroristerna supportas av försäljning av heroin. Det stämde visserligen när uttalandet gjordes, men faktum är att talibanerna innan kriget var stora motståndare till odling av opiumvallmo och var riktigt hängivna i "kriget mot droger", odlingen minskade med 90%. Efter att kriget inleddes 2001 ökade odlingen igen och nådde rekordnivåer under den nytillsatta regeringen. Talibanfraktionerna som fanns kvar såg också mellan fingrarna eftersom det var stora pengar i odlandet och dessa kunde användas i kriget mot USA[41][42][43].

Efter detta så intensifierade man flygbesprutningen av odlingar av kokabuskar och opiumvallmobuskar i Colombia. Man använder samma substans som i ogräsmedlet Roundup. Det leder till svåra förgiftningssymptom bland lokalbefolkningen och den övriga naturen. [44][45]

Bland delstaterna börjar debatten om avkriminalisering och medicinsk marijuana att växa sig starkare och efter omröstningar så lättar fler och fler delstater på sin lagstiftning.

2010-talet

Obama-administrationen

President Barack Obama var till skillnad från Clinton en ivrig förespråkare av inhalering, han var en riktig "stoner" om man ska tro ryktena. Bland annat grundade han en regel inom kompisgänget på Hawaii där den som andades ut för tidigt (innan all THC absorberats av lungorna) hoppades förbi nästa gång jointen passerade honom i ringen.[46]

Obama lovade inför valet att han skulle förändra drogpolitiken. Att man inte skulle tvinga delstater att följa federala lagar gällande cannabis om delstaterna hade stiftat lagar som exempelvis tillät tillverkning och försäljning av medicinsk cannabis.

“What I'm not going to be doing is using Justice Department resources to try to circumvent state [medical marijuana] laws on this issue simply because I want folks to be investigating violent crimes and potential terrorism. We've got a lot of things for our law enforcement officers to deal with.”

Löftet bröts och myndigheterna började istället stänga ner och åtala personer som driver cannabisapotek.[47][48].

2012 När Obama omvaldes så genomfördes det även val i Washington och Colorado som innebar att cannabis legaliserades för rekreationellt bruk. Mer om detta i kapitlet Genomgång av länder med en tillåtande narkotikapolitik. Lagändringarna trädde i kraft 2014.

2014 Obama medger i en intervju i tidningen New Yorker[49] att han tycker cannabis är mindre farligt än alkohol, men menar att det är svårt att bara legalisera:

“As has been well documented, I smoked pot as a kid, and I view it as a bad habit and a vice, not very different from the cigarettes that I smoked as a young person up through a big chunk of my adult life. I don’t think it is more dangerous than alcohol.”

...

Less dangerous, he said, “in terms of its impact on the individual consumer. It’s not something I encourage, and I’ve told my daughters I think it’s a bad idea, a waste of time, not very healthy.” What clearly does trouble him is the radically disproportionate arrests and incarcerations for marijuana among minorities. “Middle-class kids don’t get locked up for smoking pot, and poor kids do,” he said. “And African-American kids and Latino kids are more likely to be poor and less likely to have the resources and the support to avoid unduly harsh penalties.” But, he said, “we should not be locking up kids or individual users for long stretches of jail time when some of the folks who are writing those laws have probably done the same thing.” Accordingly, he said of the legalization of marijuana in Colorado and Washington that “it’s important for it to go forward because it’s important for society not to have a situation in which a large portion of people have at one time or another broken the law and only a select few get punished.”

As is his habit, he nimbly argued the other side. “Having said all that, those who argue that legalizing marijuana is a panacea and it solves all these social problems I think are probably overstating the case. There is a lot of hair on that policy. And the experiment that’s going to be taking place in Colorado and Washington is going to be, I think, a challenge.” He noted the slippery-slope arguments that might arise. “I also think that, when it comes to harder drugs, the harm done to the user is profound and the social costs are profound. And you do start getting into some difficult line-drawing issues. If marijuana is fully legalized and at some point folks say, Well, we can come up with a negotiated dose of cocaine that we can show is not any more harmful than vodka, are we open to that? If somebody says, We’ve got a finely calibrated dose of meth, it isn’t going to kill you or rot your teeth, are we O.K. with that?”

Myndigheterna börjar även öppna upp för lättade federala lagar. Personer som driver lagliga verksamheter på cannabismarknaden får exempelvis få hantera sina pengar genom det vanliga banksystemet, något som tidigare varit omöjligt p.g.a antidroglagarna[50][51].

I opinionsundersökningar från Gallup[52][53]så ser man att majoriteten av väljarna har gått från att vara förbudsförespråkare till att numera förespråka en legalisering av cannabis för rekreationellt bruk:

2014 var även året då delstaterna Oregon och Alaska, samt distriktet Washington D.C legaliserade cannabis.

Nu hade legaliseringen fått momentum, det börjar röra på sig. Under de följande åren har fler delstater legaliserat cannabis för rekreationellt bruk och antalet delstater som tillåter medicinsk cannabis ökar också.

I valet 2016 röstade Kalifornien, Nevada, Massachusetts och Maine för en legalisering för rekreationellt bruk. Det innebär att ca 20% av USA:s befolkning kan använda cannabis utan att begå ett brott. I Kalifornien infördes legaliseringen i praktiken 1 Januari 2018. Vermonts delstatsparlament röstade för legalisering för rekreationellt bruk i Januari 2018 I midterm-valet i November 2018 röstade Michigan för legalisering och i Massachusetts träder legaliseringen i kraft. 2019 röstades en legalisering av cannabis igenom i Illinois.

President Trump var inte positivt inställd till cannabislegaliseringen, men varken han eller hans drug czar's kunde göra någon skada på resultaten från folkomröstningar eller enskilda staters beslutsprocesser.

2020-talet

Under 2020-talet fortsätter legaliseringsvågen att svepa över landet. Bollen är i rullning och kan inte stoppas. Motståndet har minskat i takt med att vetenskap och kunskaper ökat samt att erfarenheterna från de första delstaterna som legaliserade har visat att det inte finns några egentliga nackdelar med att ändra narkotikapolitikens inriktning.

I valet 2020 röstade man igenom legalisering av cannabis i Arizona, Montana, New Jersey, South Dakota.

2021 legaliserades cannabis i Connecticut, New Mexico, New York och Virginia. Licensförsäljning till privatpersoner väntas komma igång 2022-2024 i olika delstater.

2022 legaliserades cannabis i Rhode Island.

Man kan med glädje konstatera att Amerikas förbudspolitik befinner sig i början av en avslutningsfas.
